Privacy Policy
1. Who we are
This Privacy Policy describes how Kiplio LLC, a Texas limited liability company doing business as Pushmaxx (“Pushmaxx,” “we,” “us,” or “our”), collects, uses, and shares information when you use the Pushmaxx mobile and web applications and related services (the “Service”).
Postal address: 945 McKinney St # 15565, Houston, TX 77002-6308, USA.
For questions about this policy, contact us at [email protected].
2. Scope
This policy covers the Pushmaxx app and related services we publish, including our marketing site, accounts, workouts, subscriptions, and online play.
It does not cover third-party websites or apps that link to or from the Service, or what another player does on their own device during an online match (see Online play).
3. Information we collect
3.1 Account and profile
- Account ID. We create an account identifier so your progress can sync.
- Linked sign-in. If you link Apple or Google, we receive identifiers and basic profile data those providers share, depending on your choices with the provider.
- Profile. Display name and training preferences you give us, plus progress tied to your account.
3.2 Workout and game data
- Session results you submit, such as scores and outcomes we use to update progress and keep play fair.
- Online match results needed to record the official outcome.
- Leaderboards and standings derived from that progress.
3.3 Device and technical data
- App version, platform, and basic device or browser details needed for compatibility and security.
- IP address and standard server logs when your device talks to our backend.
- Product analytics so we can understand usage and improve the Service.
3.4 Purchases
- Subscription status needed to unlock paid features.
- If you subscribe on the web, our payment processor handles card details. We receive customer and subscription events, not your full card number.
- If you subscribe through the App Store, Apple processes payment. We receive the identifiers needed to keep your access in sync.
3.5 Camera-derived data
See Camera and Online play. For solo training, camera frames stay on your device. Online play is the special case for optional video shared with your opponent.
3.6 Information we do not collect as product data
- We do not sell your personal information.
- We do not require height, weight, or biometric templates as a product requirement.
- We do not record or store online-match camera video on our servers.
4. Camera
Pushmaxx uses the device camera so the app can count your workout on your device.
- On-device processing. For solo sessions, camera frames are processed on your device. Those frames are not uploaded to Pushmaxx for storage or cloud vision analysis.
- Permission. Camera access is requested by the OS. You can deny or later revoke it in system settings. Without camera access, modes that need the camera will not work as designed.
- What we store from sessions. After a workout, our servers may store gameplay results you submit. That is structured game data, not a video archive of your session.
5. Online play
Online matches are different from solo training. If you turn video on, a live camera view can go to your single opponent for that match.
Before an online match, you can choose whether your opponent sees your camera or a gameplay visualization only. Gameplay still works if you keep video off.
- Live video, if you enable it, is sent to your opponent for that match. It is encrypted in transit. We do not record or store that video on our servers.
- Limited gameplay data from your device is shared with your opponent so the match can run.
- There is no broadcast and no spectator gallery. The recipient is your opponent for that match.
- Match results (such as scores and the official outcome) are processed by our servers.
We cannot control what another person does with content that reaches their screen. Keep video off if you do not want your camera image shared.
6. How we use information
- Provide, operate, and improve the Service.
- Authenticate you, sync progress, and keep play fair.
- Run progress features such as rankings and streaks.
- Enable online matches and record official outcomes.
- Process subscriptions and enforce paid access.
- Measure product usage and debug issues.
- Comply with law, enforce Terms, and protect users and the Service.
- Communicate about the Service when we have a valid reason, such as transactional notices. Marketing email, if any, will follow applicable consent rules.
7. Sharing and processors
We share information with:
- Service providers who process data on our behalf (see Third-party services for names and their own policies).
- Match opponents during online play: gameplay position data and, if you turned video on, live camera video as described above.
- Legal and safety. If required by law, valid legal process, or to protect rights, safety, and integrity of users or the Service.
- Business transfers. If we are involved in a merger, acquisition, or asset sale, information may transfer under appropriate confidentiality, with notice where required.
We do not sell personal information and we do not share it for cross-context behavioral advertising as those terms are commonly defined under US state privacy laws. If that ever changes, we will update this policy and provide required opt-outs.
8. Third-party services
We use trusted providers to run the Service. Their processing is governed by their own terms and privacy policies (and, where applicable, our data processing arrangements with them). Open a provider’s policy for full detail on how they handle data.
- Google / Firebase (accounts, cloud infrastructure): Google Privacy Policy, Google Terms of Service, Firebase Privacy and Security, Firebase Terms of Service.
- Apple (App Store, Sign in with Apple, in-app purchases): Apple Privacy Policy, Apple Media Services Terms, Licensed Application End User License Agreement.
- Stripe (web payments): Stripe Privacy Policy, Stripe Services Agreement, Stripe Consumer Terms.
- PostHog (product analytics): PostHog Privacy Policy, PostHog Terms.
- Cloudflare (website hosting and related network services): Cloudflare Privacy Policy, Cloudflare Website and Online Services Terms.
If you use Sign in with Apple or Google sign-in, those providers also process data under their policies when you authenticate. Payment card data on web checkout is handled by Stripe; we do not store full card numbers on Pushmaxx servers.
Links above may change when providers reorganize their legal pages. If a link breaks, use the provider’s official site footer or help center to find the current documents.
9. Retention
- Account and progression data are kept while your account is active and as needed to operate the Service.
- You may request account deletion in the app (where offered) or by contacting us. Deletion removes or de-identifies account-linked data we control, subject to limited retention for legal, security, fraud prevention, or dispute resolution needs, and subject to backups rotating out on our normal schedule.
- Online-match camera video is not retained by Pushmaxx as a recording. Match result records may be retained for progress, integrity, and support.
- Payment processors retain financial records under their own policies and legal obligations.
10. Security
We use industry-standard measures appropriate to a consumer fitness game, including encrypted transport to our backends and access controls on our systems. No method of transmission or storage is 100% secure. Please protect your device and sign-in methods.
11. Your choices and rights
- Camera. Controlled in OS settings.
- Online video. You can keep video off for a match. The app will ask you to confirm before you play with video on.
- Report a player. You can report another player from the app, or by emailing [email protected].
- Linked accounts. You may manage Apple or Google linkage through those providers and in-app settings where available.
- Analytics. We use product analytics to run and improve the Service. We do not sell that data or use it for ads. You can delete your account and related analytics from Settings or by emailing [email protected].
- Access, correction, deletion, export. Depending on your location, you may have rights to access, correct, delete, or obtain a copy of personal information, and to object or restrict certain processing. Contact [email protected]. We may need to verify your request.
- EEA/UK residents. Where GDPR or UK GDPR applies, our legal bases typically include performance of a contract (providing the Service you request), legitimate interests (security, product improvement, anti-cheat), and consent where required (for example certain analytics or optional video sharing). You may lodge a complaint with your local supervisory authority.
- California and similar US state laws. You may have rights to know, delete, correct, and opt out of certain sharing. We do not sell personal information. Submit requests to the email above.
12. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has created an account, contact us and we will take appropriate steps to delete the information.
Online play can share camera-derived data with another player. Parents and guardians should supervise use by teens. Additional rules may apply under local law for minors and camera data.
13. International transfers
We may process information in the United States and other countries where we or our processors operate. Those countries may have different data protection laws than your home country. Where required, we use appropriate safeguards for cross-border transfers.
14. Changes
We may update this Privacy Policy from time to time. We will post the updated version on this page and change the “Last updated” date. Material changes may also be called out in the app or by other reasonable notice. Continued use after the effective date means you accept the updated policy, except where consent is required by law.
