1. Agreement to these Terms

These Terms of Service (“Terms”) are a contract between you and Kiplio LLC, a Texas limited liability company doing business as Pushmaxx (“Pushmaxx,” “we,” “us,” or “our”), 945 McKinney St # 15565, Houston, TX 77002-6308, USA, governing your access to and use of the Pushmaxx applications, websites, and related services (the “Service”).

By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum digital consent age in your country, if higher) to use the Service. If you are under the age of majority where you live, you may use the Service only with a parent or guardian’s involvement and consent where required.

Online play can share gameplay data and, if you turn video on, a live camera view with another player. You must meet any higher age or capability requirements we state in the app or store listing for those features.

You represent that you can form a binding contract and that you will comply with these Terms and applicable law.

3. Accounts

The Service may create an anonymous account so you can start quickly. Progress is tied to that account identifier on our systems.
You may link Apple or Google sign-in to keep access across devices. Keep your provider credentials secure. Those providers process sign-in under their own terms (Apple Privacy, Google Privacy, Google Terms).
You are responsible for activity under your account. Tell us promptly if you suspect unauthorized use.
Display names and profile fields must not be abusive, infringing, or misleading. We may reclaim or change names that violate these Terms.
Account deletion, where offered in the app or via support, is subject to our Privacy Policy and any legal retention needs.

4. The Service

Pushmaxx is a competitive push-up training game. Features may include camera-assisted workouts, training programs, online matches, progress systems, and optional Premium features.

We may change, suspend, or discontinue features, balance gameplay, fix exploits, and update anti-cheat rules. The Service is provided for entertainment and personal fitness motivation, not as a medical device or professional coaching service.

5. Health and safety disclaimer

Consult a doctor before starting any exercise program, especially if you have injuries, pain, or medical conditions. Stop if you feel pain, dizziness, or distress.

You are solely responsible for how you perform exercises and for choosing a safe environment (stable phone placement, clear floor space, appropriate surface).
Camera guidance and scoring are approximate. They can miscount or misread form. Do not rely on the app as a medical or safety system.
Online matches can encourage intensity and competition. Pace yourself. Do not attempt feats beyond your capacity.

6. Online play

When you play online, you participate in a real-time match against another player. Current rules are described in the app.

6.1 Privacy choices

Before a match, you can choose whether your opponent sees your camera or a gameplay visualization only.
If you turn video on, a live camera view of you may be sent to your opponent for that match. It is encrypted in transit.
If you keep video off, we do not send your camera picture to the opponent. Limited gameplay data from your device still goes to the opponent so the match can run.
Pushmaxx does not record or store online-match video on our servers. Match results are processed by us as described in the Privacy Policy.

6.2 Your responsibilities

Only turn video on if you are comfortable appearing on your opponent’s screen for that match.
Do not harass, threaten, expose private information, or behave inappropriately on camera.
Do not record or redistribute another player’s video or likeness without a lawful basis and their consent where required.
Do not cheat or exploit the Service. We may void results, reset progress, or ban accounts.
Invite links or codes are meant for people you choose. Sharing them publicly can let strangers join.

6.3 Fair play and official results

We validate submitted results and decide official outcomes. Network issues and device performance can affect a match. Rematches are not guaranteed.

7. Acceptable use

You agree not to:

Violate law or third-party rights
Reverse engineer, scrape, or overload the Service except as allowed by law
Probe or attack infrastructure, or bypass security or rate limits
Impersonate others or misrepresent affiliation
Use the Service for commercial resale without our written permission
Interfere with other players’ enjoyment or safety
Upload malware or attempt unauthorized access to accounts or data

8. User content and feedback

If you submit display names, feedback, ideas, or other content to us, you grant Pushmaxx a worldwide, non-exclusive, royalty-free license to use, host, and display that content as needed to operate and improve the Service. Feedback may be used without obligation to you.

You represent that you have the rights to content you submit and that it does not violate law or these Terms.

Report abusive usernames, online-match conduct, or other violations from the app or by emailing [email protected]. We may reclaim names, void results, or suspend accounts.

9. Intellectual property

The Service, including software, design, game systems, text, graphics, and trademarks, is owned by Pushmaxx or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership to you. You receive a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes as allowed by these Terms and the app store terms that apply to your download.

10. Subscriptions and payments

Some features require a paid Premium subscription or other in-app purchase.
iOS. Purchases through Apple are billed by Apple under the Apple Media Services Terms and related App Store policies (including the Licensed Application EULA). Manage or cancel in your Apple ID subscription settings. Refunds are handled by Apple under its policies. See also Apple’s Privacy Policy.
Web. Purchases through Stripe are billed under the plan shown at checkout and Stripe’s Consumer Terms / Services Agreement as applicable. Payment data is processed under the Stripe Privacy Policy. Manage or cancel via the billing portal or the tools we provide. Taxes may apply.
Prices, trials, and plan details may change. We will present the terms at purchase. Unless required by law, fees are non-refundable once a billing period starts, except as stated by the platform that charged you.
Entitlements may take a short time to sync after purchase, restore, or refund. Abusing trials, chargebacks in bad faith, or payment fraud may result in suspension.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT REP COUNTS, FORM JUDGMENTS, MATCH OUTCOMES, OR LEADERBOARDS WILL BE ACCURATE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUSHMAXX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US $50).

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the fullest extent permitted.

13. Indemnity

You will defend and indemnify Pushmaxx and its personnel against claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your infringement of someone else’s rights, including claims related to your live video or conduct in Battle.

14. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. After termination, sections that by nature should survive (including ownership, disclaimers, limitations, and indemnity) continue to apply.

15. Governing law

These Terms are governed by the laws of the State of Texas, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise. Courts in Harris County, Texas will have jurisdiction, subject to those mandatory protections and any platform dispute process that applies to store purchases.

16. Changes to these Terms

We may update these Terms by posting a new version on this page and updating the “Last updated” date. Material changes may also be highlighted in the app. If you continue to use the Service after the effective date, you accept the revised Terms, except where consent is required by law.
